This site is owned and operated by FitKid Ltd (“FitKid"). Please read these terms and conditions carefully, they are the terms of use for this site as provided by FitKid.

In these Terms and Conditions “we, our, us, or FitKid” refers to FitKid Ltd.

Acceptance of Terms

By accessing the content of www.fitkid.co.uk (“the Website”) you agree to be bound by the terms and conditions set out herein and you accept our Privacy Policy (ADD LINK). If you object to any of the terms and conditions set out in this agreement you should not use any of the products or services on the Website and leave immediately.

You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information.

You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

The use of this site is only for lawful purposes, in a manner which does not infringe the rights of or restrict or inhibit the use and enjoyment of this site by any third party. Such restriction or inhibition includes, but is not limited to, conduct which is defamatory, or which may harass, cause distress or inconvenience to any person and the transmission of obscene or offensive content or interruption of the normal flow of dialogue within this site.

Modification

FitKid reserve the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement.

FitKid. have complete discretion to modify or remove any part of this site without warning or liability arising from such action.

Limitation of Liability

FitKid will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Website.

Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of FitKid, its employees or agents.

Copyright

All intellectual property of FitKid or its partners such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the Website remain the property of FitKid or its partners.

By using the Website you agree to respect the intellectual property rights of FitKid and its partners and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for any commercial purpose any material contained within the Website.

Data Transmission

Any information or data you transmit through or post on the site where permissible will be non-confidential and shall belong absolutely to FitKid. The information may be used by FitKid for any purpose including, but not limited to, reproduction, disclosure to third parties, posting or otherwise at FitKid absolute discretion (according to and subject to The Data Protection Act, see Privacy Statement). You hereby assign to FitKid (by way of permanent assignment of present and future copyright) all rights of any nature in and to such material throughout the world including all renewals and reversions thereof.

Placing an Order

Placing an order could not be any simpler. Browse our online shop and click ‘Buy’ next to any items that you want to purchase. This places the items into your shopping basket, which can be reviewed at any point. When you are happy with the contents of your shopping basket you can proceed to the checkout where you will enter your delivery and billing details. As we do not store your credit card details, these will need to be entered each time you make a purchase.
All prices quoted on this website include VAT where appropriate.
After you have placed your order, we will send a confirmation email to you summarising the order. We accept payment in sterling by Switch, Visa or MasterCard.
When we receive your order, we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfill the transaction.
If you are not sure about placing an order online, please feel free to speak to us on the telephone instead and we will do all we can to accommodate you. We can be reached on +44 (0) 870 085 1000 Monday - Friday 10am- 5pm GMT.

Delivery

All items for sale are usually kept in stock. If for any reason we cannot dispatch your order within 5 working days (excluding weekends), we will notify you by telephone or email. You will be given the opportunity to cancel the item(s) out of stock, or will be given an expected date of delivery.

Our standard delivery charges can be viewed on the order form when you enter your billing details and shipping address.

When specifying a delivery address, please bear in mind that many of the items we supply will not fit through a standard letterbox, so if you are not at home when delivery is attempted you may need to pick them up from your local sorting office. For your convenience, we offer the option to specify a different delivery address from that used for billing.

Returns Policy

We always aim to achieve 100% customer satisfaction. We are continually expanding to provide a larger range to give our customers more choice.
If you wish to return an item which is not suitable or no longer required, you should call us within 5 days of receiving the item to inform us and should then return the item in original packaging, undamaged within 5 days from the date of the call. You should include paperwork with the original order number stated. We recommend using Royal Mail’s parcel service in all cases.
When the item arrives with us we will refund your card for the cost of the item in full but NOT the cost of returning the item to us. You can choose to have a replacement item (if available).
The goods must be unused and we will review the condition of the goods before issuing a refund or replacement, and contact you if the claim is in doubt.

Severance

If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms and conditions shall survive and continue to be binding and enforceable.
